Criminal Records v Convictions (what’s the difference)?

In this topic

Having a criminal record and convictions are not the same thing. A criminal record consists of any items where you have come into contact with the criminal justice system. Simply put, if you get sentenced in a court, then you have a conviction. A conviction is a court mandated disposal where you have a received a sentence from the court. Criminal records will show other items too like non-court disposals.

These are items that could appear on your record if you are applying for roles that require a standard or enhanced type of criminal record check.
Some of these disposals listed will apply only to those under the age of 18 only, adults (over 18) or to both categories. Please find a comprehensive guide these types of offences below.

Examples of these types of offences are :

For under 18s:

  • informed warnings
  • restorative cautions
  • Diversionary youth conferences/plans

For adults:

  • Community Resolution Notices
  • Cautions
  • Penalty Notice of Disorder (PND)
  • Informed Warning

For more detail and information you can find the guide to Non-Court Disposals here
