Motoring Convictions – A guide

If you’re convicted of a motoring offence, the courts can fine you and endorse your driving licence with penalty points. Endorsements must stay on your driving licence for four or 11 years, depending on the offence.

So, what are the differences between criminal records and driving offences and where do they matter in terms of disclosure?


Simply put, if the offence results in a period of custody being given, then the usual criminal disclosure rules apply. This will usually mean the offences were at the more serious end of the scale.


As a rule, driving convictions will not show on an AccessNI unless a period of custody, suspended or not, applies, as well as fines and/or probation orders.


Any motoring offence that results in a court appearance and conviction will show on an AccessNI certificate if unspent. Any motoring conviction received during a driving ban period will result in the driving ban conviction period being restarted.
